Acceptance of Terms

By downloading, installing, or using MediScan+ (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

These Terms constitute a legally binding agreement between you and MediScan+ (Private) Limited (“Company”, “we”, “us”, “our”), registered under the laws of the Islamic Republic of Pakistan.

By accessing or using any part of the Platform, you represent that you are at least 13 years of age, have the legal capacity to enter into this agreement, and have read and understood these Terms in full. If you are using the Platform on behalf of an organisation, you further represent that you are authorised to bind that organisation to these Terms.

Platform Description

MediScan+ is an AI-powered medicine authentication platform designed to help verify the authenticity of pharmaceutical products in Pakistan. Our technology combines computer vision, barcode parsing, and multi-agent AI pipelines to compare scanned medicines against a database of verified manufacturer samples.

IMPORTANT MEDICAL DISCLAIMER: MediScan+ is NOT a medical device. Scan results are informational only and do NOT constitute medical advice, diagnosis, or treatment. Always consult a qualified, licensed healthcare professional before making any medical decision. The Platform does not replace the regulatory authority of DRAP (Drug Regulatory Authority of Pakistan) and does not guarantee the safety or efficacy of any medicine.

The Platform serves multiple user categories including consumers, registered pharmacies, pharmaceutical manufacturers, healthcare facilities, and government regulatory bodies. Each category is subject to additional terms set out in Section 3.

We reserve the right to modify, suspend, or discontinue any feature of the Platform at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation of the Platform or any part thereof.

User Categories

3.1 — Consumers & Patients

  • May use the app to scan medicines for personal use.
  • Scan results are advisory only — they must not be relied upon as a sole basis for any medical decision.
  • Must be at least 13 years of age. Users aged 13–17 must have parental or guardian consent.
  • Free Tier: Up to 3 prescription analyses per month; unlimited medicine barcode scans.
  • Premium: Unlimited prescription analyses, priority AI processing, and advanced ADR tracking.

3.2 — Registered Pharmacies

  • Must hold a valid, current Drug Sale Licence issued by DRAP or the relevant provincial health authority.
  • API keys and portal credentials are non-transferable. Each pharmacy location must operate under its own registered account.
  • Must not share, resell, sublicense, or otherwise transfer access to any third party.
  • Are solely responsible for the accuracy of pharmacy registration details, including name, address, DRAP licence number, and contact information.
  • Must notify us in writing within 7 days of any licence expiry, suspension, or revocation.
  • Prohibited uses: Using the Platform to verify medicines not physically in stock at the registered location, or for competitor intelligence.

3.3 — Pharmaceutical Manufacturers

  • Must be a company registered and licensed with DRAP to manufacture pharmaceutical products in Pakistan.
  • Are solely and entirely responsible for the accuracy, completeness, and currency of all batch data uploaded to the Platform.
  • Uploading false, misleading, or fraudulent batch data constitutes fraud under the Pakistan Penal Code 1860 and may result in immediate account termination and referral to DRAP and law enforcement authorities.
  • Golden sample photographs must depict genuine, current product packaging only. Staged or manipulated samples are strictly prohibited.
  • By uploading batch data, manufacturers grant MediScan+ a limited, non-exclusive, royalty-free licence to use that data solely for authenticating their products on the Platform.

3.4 — Healthcare Facilities & Hospitals

  • All terms applicable to Registered Pharmacies apply equally.
  • Bulk verification use cases are governed by a separate Enterprise Services Agreement.
  • Healthcare facilities may not use scan data in patient medical records without obtaining appropriate patient consent.

3.5 — DRAP & Government Officials

  • Portal access is granted exclusively for official regulatory, investigative, or public health monitoring purposes.
  • Data accessed through the DRAP portal must not be shared outside official regulatory channels without appropriate authorisation.
  • Government officials are bound by all applicable government data protection obligations in addition to these Terms.
  • Any unauthorised disclosure of Platform data by a government official will be reported to the relevant oversight authority.

Prohibited Activities

You agree not to engage in any of the following activities, whether directly or indirectly, by yourself or through a third party:

Violations of these prohibitions may result in immediate account termination, civil liability, and/or criminal prosecution under applicable Pakistani law.
  • Attempting to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Platform, its AI models, or any component thereof.
  • Uploading fake, misleading, manipulated, or fraudulent medicine batch data, sample images, or ADR reports.
  • Using the Platform in any way that facilitates or assists in the manufacture, sale, distribution, or promotion of counterfeit, adulterated, or substandard medicines.
  • Sharing, selling, leasing, or otherwise providing API keys, portal credentials, or account access to any third party.
  • Automated scraping, harvesting, or systematic extraction of scan results, medicine data, pharmacy listings, or any other Platform content.
  • Using the Platform commercially outside Pakistan without our prior written consent.
  • Attempting to manipulate, bias, or deceive our AI models to produce false or misleading scan verdicts.
  • Creating false, fabricated, or malicious Adverse Drug Reaction (ADR) reports with the intent to harm a manufacturer's reputation or mislead regulators.
  • Using the Platform for any purpose that violates the Pakistan Electronic Crimes Act (PECA) 2016, the Pakistan Penal Code 1860, or any other applicable law.
  • Interfering with the security, integrity, or availability of the Platform, including denial-of-service attacks, injection attacks, or credential stuffing.

Intellectual Property

All technology, software, AI models, scan algorithms, GS1 barcode parsing logic, UI designs, brand assets, and content on the Platform (collectively, “Our IP”) are owned by or exclusively licensed to MediScan+ (Private) Limited. All rights are reserved.

You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform solely for its intended purposes and in accordance with these Terms. No other rights are granted.

Medicine batch data, product specifications, and brand assets uploaded by pharmaceutical manufacturers remain the intellectual property of the respective manufacturer. By uploading such data, manufacturers grant us the limited licence described in Section 3.3. We do not claim ownership over manufacturer-uploaded content.

Feedback, suggestions, or ideas you submit regarding the Platform may be used by us freely and without obligation or compensation to you.

Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY. It limits our legal liability to you and may affect your rights.

MediScan+ provides scan results on a best-efforts basis using AI technology. We do not warrant or guarantee 100% accuracy in detecting counterfeit, adulterated, or expired medicines. AI-based verification is a supplementary tool and not a definitive legal or medical determination.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE PAKISTANI LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE PAKISTANI LAW, WE SHALL NOT BE LIABLE FOR:

  • Any physical harm, illness, death, or adverse health outcome arising from consuming a medicine based on a scan result provided by the Platform.
  • Any business loss, loss of revenue, loss of profits, or loss of commercial opportunity suffered by a business user as a result of a scan verdict.
  • Any loss or corruption of data arising from system outages, server failures, or cyberattacks beyond our reasonable control.
  • Any indirect, consequential, special, incidental, or punitive damages, even if we have been advised of the possibility of such damages.
  • Any loss arising from your reliance on scan results in violation of the medical disclaimer in Section 2.

Our maximum aggregate liability to any user for any and all claims shall not exceed PKR 50,000 (Pakistani Rupees fifty thousand) or the total amount paid by you to us in the twelve (12) months preceding the claim, whichever is less.

Nothing in these Terms excludes liability for death or personal injury caused by our gross negligence, or for fraud or fraudulent misrepresentation.

Subscription & Payments

Free Tier

  • Up to 3 AI prescription analyses per month.
  • Unlimited medicine barcode and QR code scans.
  • Basic features including scan history and basic ADR reporting.
  • No payment information required.

Premium Subscription

  • Unlimited prescription analyses with priority AI processing.
  • Advanced ADR tracking, medication reminders, and health dashboard.
  • Prices as listed in-app at the time of subscription.
  • Payment accepted via EasyPaisa, JazzCash, and major credit/debit cards. All transactions are processed securely by our payment partners.
  • Subscriptions auto-renew on a monthly basis unless cancelled at least 24 hours before the renewal date.
  • Payments are non-refundable once a billing period has commenced and the associated features have been accessed.
  • We reserve the right to change subscription prices with 30 days' advance notice. Continued use after a price change constitutes acceptance of the new price.

B2B & Enterprise

API access, bulk verification plans, and enterprise agreements for pharmacies, manufacturers, and healthcare facilities are priced separately. Contact business@mediscanplus.com for enterprise pricing.

Account Termination

Termination by Us

We may suspend or permanently terminate your account immediately and without prior notice if:

  • You violate any provision of these Terms.
  • Your DRAP licence, drug sale licence, or manufacturing licence is suspended, revoked, or expires without renewal.
  • We detect fraudulent activity, including uploading false data or manipulating scan results.
  • You engage in any Prohibited Activity set out in Section 4.
  • We are required to do so by applicable law, court order, or regulatory directive.

Upon termination, your licence to use the Platform ceases immediately. Termination does not affect any accrued rights, obligations, or liabilities of either party.

Termination by You

You may delete your account at any time via Settings → Account → Delete Account in the mobile app, or by emailing legal@mediscanplus.com. Upon confirmed deletion, your personal account data will be permanently deleted within 30 days, subject to our data retention obligations described in our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan. Both parties irrevocably submit to the personal jurisdiction of such courts.

Either party may seek interim injunctive or equitable relief from any court of competent jurisdiction to prevent irreparable harm pending dispute resolution. Disputes may also be resolved through mutual written agreement to arbitration under the Arbitration Act 1940 (as amended), with arbitration seated in Lahore, Pakistan.

Changes to Terms

We may update these Terms from time to time. Where changes are material, we will provide at least 30 days' advance notice via:

  • Email to your registered email address.
  • An in-app notification in the MediScan+ mobile application.
  • A prominent notice on this page.

Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree, you must stop using the Platform and may delete your account as described in Section 8.

We will maintain a version history of these Terms. You may request a copy of any prior version by emailing legal@mediscanplus.com.
